Terms of Use – Business Local Directory

1. Acceptance of Terms

By accessing or using Business Local Directory and its associated services ("the Service"), you agree to these Terms of Use ("TOU").

If you disagree with any part of the TOU or future modifications, your sole recourse is to discontinue use of the Service.

2. Modifications to the TOU

Business Local Directory may change these terms at any time, effective immediately upon posting on our website.

You are responsible for reviewing the TOU regularly to remain informed.

3. Eligibility for Use

Some areas of the Service are reserved for professional users.

We reserve the right to refuse or remove access at our discretion.

4. User-Generated Content

You are solely responsible for any content you post. By submitting content, you:

• Warrant that it is lawful and that you hold all rights to it

• Grant Business Local Directory a non-exclusive, perpetual, worldwide, royalty-free licence to use, display, distribute, and create derivative works

• Waive any rights related to your likeness or publicity regarding content posted

We do not control user content and disclaim liability for offensive, inaccurate, or inappropriate content.

We may remove content that violates these terms at our sole discretion.

5. External Links

Business Local Directory may contain links to third-party websites. We are not responsible for their content or accuracy.

6. Infringement Notifications

To report copyright or IP infringement, please contact accounts@businesslocal.com.au with the necessary details.

We comply with Australian copyright laws.

7. Privacy

Your personal information is handled in accordance with our Privacy Policy.

8. Prohibited Conduct

You agree not to post or transmit content that:

• Is unlawful, offensive, or discriminatory

• Violates intellectual property rights

• Contains spam, malware, or impersonation

• Involves unauthorised access, data scraping, or automation

We may suspend or terminate your access if you breach these rules.

9. Posting Agents

Posting on behalf of others requires express written permission from Business Local Directory.

10. No Spam

Sending unsolicited messages through our systems is prohibited and may result in penalties.

11. Paid Postings

Certain features may require payment. Fees are non-refundable if posts are removed due to TOU violations.

12. Service Limitations

We may impose limits on use and availability without notice or liability.

13. Access Rights

You are granted a limited, non-exclusive licence to access the Service for personal or authorised business use.

Use of bots, data scraping, or republication without permission is prohibited.

14. Termination

We may terminate or suspend your access for any breach of the TOU. Sections 2, 4, 7, 8, 13–20 survive termination.

15. Intellectual Property

All content and branding on the platform is the property of Business Local Directory or its licensors.

Use of our trademarks or content without written permission is not allowed.

16. Disclaimer of Warranties

We provide the Service "as is" without warranties of any kind. We do not guarantee accuracy, reliability, or uninterrupted access.

17. Limitation of Liability

To the extent permitted by law, Business Local Directory is not liable for any direct or indirect loss resulting from your use of the Service.

18. Indemnity

You agree to indemnify and hold Business Local Directory harmless from any claims arising from your content, use of the Service, or violations of the TOU.

19. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes must be resolved in the courts of that jurisdiction.

20. Enforcement and Liquidated Damages

Violations such as impersonation, unauthorised scraping, and spam may result in liquidated damages.

We reserve the right to enforce penalties as described in detail in the full TOU.

22. Programs and Services Terms

Use of Business Local’s service-matching programs implies agreement that:

• All transactions are between Consumers and Professionals

• Business Local Directory is not a party to these agreements

• Liability is limited to $25.00

23. Brand Agreement

By logging in, you agree to grant Business Local Directory the right to display your brand content, including logos, images, and catalogues.

Fees, billing, and termination terms apply as outlined on the platform.

24. Free Account Listings

Only one business listing is allowed per ABN under the free membership.

Additional listings require a paid plan.

Duplicate listings may be removed and the account suspended.
